TERMS OF USE...
- COMMERCIAL USE:
Our images may not be used for commercial endeavors, this includes television, books, ebooks, magazines, professional web and graphic design, digital scrapbook designers, etc. We may offer a licensed version of our products to assist commercial use. Information will be posted on the website when such a license is available.
- NON COMMERCIAL USE:
All of the images we offer on cd or download may be used for personal use and incorporated into your own artwork or craft project for resale. This includes, altered books, altered art, ATC's, jewelry, journals, fabric squares, collage sheets, etc. One exception to creating your own collage sheets with our images is that you may not use images from our collage sheets to do this.
- COLLAGE SHEETS:
You may use the images from our collage sheets to incorporate into your own artwork. You may not copy and print the collage sheets for resale either digitally or in print for resale or redistribution to others.
- STOCK PHOTOS:
Our stock photos may be used to incorporate into your own artwork for resale. They may not printed and sold in their original form. No exceptions.
- SHARING IMAGES:
We ask that you refrain from this. Please do not share, loan, rent or post across a bulletin board, network, Internet or web page. In other words, please do not share our images with others and/or make them available as a "free image" on your website, myspace or blog.
- EXCLUSIVE IMAGES:
Please do not take credit for the altered images (my original artwork) I have added to our cds or downloads or claim them as your own work. These will be marked as an exclusive "Enchanted Mercantile" or "Ms Delaise" work. These are for personal use only.
- THE REST:
You may not use my images for any harmful, pornographic, obscene, defamatory, immoral or racial material or anything
that may be harmful or offensive to another person.
We ask the you use our images responsibly, if you have any doubts, please contact us for more information.
Enchanted Mercantile disclaims any and all liability for unsatisfactory results. Images on our CDs and download images have been tested and are presented in good faith, but no warrenty is given, nor results guarenteed. We do, however, guarentee the CDROM, if it is faulty, we will replace it.
TERMS OF USE FREQUENTLY ASKED QUESTIONS:
Q. May I use your images to create web templates?
A. Not for commercial use. For personal use only, however, if you use our allowed images to design personal web templates, a link bank to Enchanted Mercantile must be added to each page of the template or web page designed. ie: image courtesy of www.enchantedmercantile.com.
Q. May I add your images to my web site to use for e-cards?
A. A limit of ten images is allowed to display on a website for ecards with a link back to Enchanted Mercantile for the use of the images.
Q. Can I print these images for resale as postcards, collage sheets, greeting cards, etc?
A. All images from our cds may be used to create art projects such as collage sheets, greeting cards, ATCs, collage art, etc. You may also use our images to create business cards, stationary and calling cards. Please do not use the images from our collage sheets to create collage sheets. Our stock photos may be use to create collage sheets if they are altered.
Q. How can you copyright public domain images?
A. Our CD images are protected under U.S. and International Copyright Laws as a "compilation" since first published and offered for sale. A compilation is defined as a work formed by the collection and assembling of preexisting materials or of data that are selected, coordinated, or arranged in such a way that the resulting work as a whole constitutes an original work of authorship. Individual images on the CDs may be used without further payment, permission or acknowledgment for commercial, noncommercial or personal use, unless otherwise stated.
By purchasing our cds/downloads, you are agreeing to our terms of use. Purchasing our images does not transfer rights of ownership or any copyrights we hold. We are an "Angel" company, which allows the use of our images for limited use without the purchase of a license.
Q. Your Collage Sheets CDs are great, how do the collage sheet cd terms of service differ from your other cd compilations?
A. Our collage sheets may not be printed and sold as collage sheets. You may, however use them as described above.
Q. I want to make collage sheets and greeting cards using your images, then sell them in mass production to a store chain. Is this allowed?
A. Mass production sales using our images is allowed with prior permission from Enchanted Mercantile. We reserve the right to determine if a commercial use license needs to be purchased from us regarding the situation. This will be determined on a case by case basis.
Q. I teach an altered book class, may I use your images for my students to create their class projects?
A. Absolutely! We encourage the use of our images for art education and inspiration!
Q. Do I need special permission to add your images to a cd compilation?
This is not allowed, our images may not be added to a cd compilation or any other digital format. Our Cds may not be copied, resold, or redistributed.
FREQUENTLY ASKED QUESTIONS ABOUT OUR CD COLLECTIONS
Q. Are your cds compatible with a Macintosh?
A. Yes, the cd compilations work great with a Mac, your jpeg image viewer will open the images just fine.
Q. What resolutions are your images scanned at?
A. The images are our cds are 300 dpi or higher. They have been digitally enchanced and corrected to insure quality in viewing and use.
Q. Will I violate any copyrights if I use the images commercially?
A. Yes, a license must be purchased for commercial use. WE are not offering a commercial license at this time, however, sometime in 2008 we will have this available.
Q. What is your refund policy?
A. We do not give refunds for our cds, however we do replace faulty cds. In rare instances, we do exchange one cd for another, but this is done on a case by case basis. Please consider our refund policy before making your purchase.
Q. Why do you not give refunds?
A. We have a "common sense" policy that helps to insure that our cds are not purchased to copy them, then return them for a refund. We believe that 99% of our customers are good and honest, however, to prevent misuse of our cds, we do not offer cash refunds.
Q. I am new to scrapbooking, are your cds self staring and easy to use?
A. Our cds are organized and easy to naviagte. No, we do not impliment any self starting programs on our cds. You may view them through your default image viewer or paint programs. ie: Paint Shop Pro, Photoshop, etc. For your convienance, we have included an image viewer to download onto your computer. It will allow you to view the images as thumbnails or as a slide show. Our study has shown that most "artists" prefer to view the images through their own programs, they prefer to download the images to their computer, and view them without an invasive self starting browser. Our cds are "easy" to use for the novice scrapbooker or artist as well as the professional.
Q. Do you offer technical support?
A. Our technical support is limited to aswering questions about launching the cd, cd navigation and help with downloads, etc. Questions about printing techniques, software, photo editing, etc should be directed to your printer manual, photo editing program manual, etc or their customer support. In any case, we will do our best to answer all questions recieved.
ADDITIONAL INFO
All images and text used in our ebay listings and websites are copyrighted and may not be copied in any form. Linking to our images is illegal and considered bandwidth theft. Appropriate action(s) will be taken to those who violate these terms and conditions.
